1. Introduction
This Privacy Policy describes how Tenth Finder ("we", "us", "our") collects, uses, and protects your information when you use our mobile application and related services (the "Service"). This policy applies to our Android application available on Google Play Store. By using the Service, you consent to this Privacy Policy.
2. Information We Collect
2.1. Account Information: When you make a purchase, we collect your email address through our payment processor (Stripe). This email is used for purchase receipts and account identification.
2.2. Telemetry Data: The app downloads karting telemetry data (GPS coordinates, speed, RPM, lap times) from your AIM MyChron device via WiFi. This data is stored locally on your device only and is not uploaded to our servers unless you choose to use AI coaching analysis.
2.3. AI Analysis Data: When you use AI coaching analysis, session telemetry is sent to our servers for processing. Analysis results are stored in our cloud database linked to your account.
2.4. Payment Information: Payment processing is handled entirely by Stripe. We do not store your credit card numbers or banking details. Stripe's privacy policy governs payment data.
2.5. Device Information: We may collect device identifiers, operating system version, and app version for crash reporting and service improvement purposes.
3. Data Security - No Guarantees
3.1. encryption: We provide optional encryption features for your data. However, we do not guarantee the security, integrity, or confidentiality of any information you store, whether encrypted or not.
3.2. no absolute security: While we implement reasonable security measures, no system is completely secure. Data breaches, hacking, unauthorized access, and technical failures can occur. You use the Service at your own risk regarding data security.
3.3. your responsibility: You are solely responsible for: (i) maintaining the confidentiality of your passwords and encryption keys; (ii) backing up your data regularly; (iii) encrypting sensitive information before storage; (iv) any consequences of data loss, theft, or unauthorized access; and (v) ensuring appropriate security measures for your use case.
4. Data Ownership and Responsibility
4.1. Your data belongs to you. We do not sell, trade, or rent your personal information to third parties for marketing purposes.
4.2. We are not responsible for: (i) loss of data due to technical failures, user error, security breaches, or any other reason; (ii) unauthorized access to your account or data; (iii) any damages, losses, or consequences resulting from data breaches, regardless of cause; (iv) recovery or restoration of lost data; or (v) maintaining backups of your data.
5. How We Use Your Information
5.1. We use collected information to: (i) provide and maintain the Service; (ii) authenticate users; (iii) improve and optimize the Service; and (iv) communicate important updates or security issues.
5.2. We may use aggregated, anonymized data for analytics purposes to improve the Service, but such data cannot be used to identify you individually.
6. Third-Party Services
6.1. We use third-party service providers for: (i) authentication and data storage; (ii) payment processing; (iii) AI-powered coaching analysis. Each provider has its own privacy policy governing their handling of data.
6.2. When you use AI coaching analysis, only technical telemetry data (GPS coordinates, speed, RPM, lap times) is processed. No personal information is included in this analysis.
6.3. We are not responsible for the privacy practices of third-party service providers.
7. Data Retention and Deletion
7.1. Telemetry session data is stored locally on your device. You can delete this data at any time by deleting sessions within the app or uninstalling the application.
7.2. Cloud-stored data (kart configurations, account information) is retained while your account is active. Inactive accounts may be deleted after 12 months of inactivity.
7.3. To request deletion of your account and all associated data, contact us at support@tenthfinder.com. We will process deletion requests within 30 days. Note that some data may be retained in backups for up to 90 days.
8. Cookies and Tracking
8.1. We use cookies and similar technologies to maintain sessions, store preferences, and collect usage analytics.
8.2. You may disable cookies in your browser settings, but this may limit Service functionality.
9. Children's Privacy
9.1. The Service is not intended for users under 13 years of age. We do not knowingly collect information from children under 13.
9.2. Users aged 13-17 must have parental consent and supervision as outlined in our Terms of Service.
10. International Data Transfers
10.1. Your data may be transferred to, stored, and processed in countries other than your own. These countries may have different data protection laws.
10.2. By using the Service, you consent to such transfers and acknowledge that we are not liable for compliance with foreign data protection regulations.
11. Changes to Privacy Policy
11.1. We may update this Privacy Policy at any time without notice. Changes are effective immediately upon posting.
11.2. Your continued use of the Service after changes constitutes acceptance of the new Privacy Policy. We have no obligation to notify you of changes.
12. In-App Purchases
12.1. The Service offers AI coaching credits for purchase. All payments are processed securely by Stripe. Purchase details and transaction history are associated with your account.
12.2. Refund requests should be directed to support@tenthfinder.com. Refunds are handled on a case-by-case basis in accordance with our Terms of Service.
13. Device Permissions
13.1. WiFi/Network Access: Required to connect to your AIM MyChron device and download telemetry data. Also required for cloud synchronization and AI analysis features.
13.2. Storage: Required to save telemetry session files locally on your device.
14. Limitation of Liability
14.1. To the maximum extent permitted by law, we disclaim all liability for: (i) any data loss, corruption, or theft; (ii) privacy breaches or unauthorized access; (iii) any damages resulting from your use of the Service; and (iv) any issues related to your data, privacy, or security.
14.2. The Service is provided "as is" without warranties of any kind. You acknowledge and accept all risks associated with using the Service.
15. Your Rights
15.1. Depending on your jurisdiction, you may have rights to access, correct, or delete your personal data. To exercise these rights, contact us at support@tenthfinder.com.
15.2. Data portability, if requested, will be provided in a standard format (JSON), but we do not guarantee compatibility with other systems.
