1.3. no responsibility for decisions: Any decisions you make based on information from the Service are your sole responsibility. We are not liable for any losses, damages, or consequences resulting from your use of, or reliance on, the Service.

1.4. technical issues: We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

2.3. You are solely responsible for maintaining the security of your account and password. You agree not to disclose your password to any third party.

2.4. prohibited activities: You agree not to: (i) use the Service in any way that violates applicable laws or regulations; (ii) use automated systems (bots, scripts, scrapers) to access the Service without our written permission; (iii) attempt to gain unauthorized access to any portion of the Service or other accounts; (iv) interfere with or disrupt the Service or servers/networks connected to the Service; (v) resell, redistribute, or provide access to the Service to third parties; (vi) use the Service for any commercial purpose beyond managing your personal karting setups; or (vii) engage in any activity that could damage, disable, overburden, or impair the Service.

2.5. device authorization: You may only connect to and download data from telemetry devices (such as AIM MyChron) that you own or have explicit permission from the owner to access. Connecting to or downloading data from another person's device without their authorization is strictly prohibited and may violate applicable laws. We are not responsible for any unauthorized access to third-party devices.

3.1. sole responsibility: You are solely responsible for: (i) all decisions made using information from the Service; (ii) the accuracy and appropriateness of any data you input; (iii) the consequences of using configurations or settings from the Service; (iv) ensuring your use complies with all applicable laws; and (v) any damage or injury resulting from application of information obtained from the Service.

3.2. karting safety: You acknowledge that karting involves inherent risks of serious injury or death. You assume all risks associated with using any configurations, settings, or information from the Service in real-world karting activities. We are not responsible for any accidents, injuries, property damage, or death resulting from your use of the Service.

3.3. no professional advice: The Service does not provide professional mechanical, safety, or racing advice. Any information provided is for informational purposes only and should not be considered professional advice. Always consult qualified professionals before making karting modifications or setup changes.

3.4. AI coaching disclaimer: AI-generated coaching analysis is provided for educational and informational purposes only. AI suggestions regarding braking points, racing lines, corner speeds, or driving techniques are not guaranteed to be safe or appropriate for your specific situation, skill level, track conditions, or equipment. You assume all risks when following AI-generated advice. We are not responsible for any accidents, injuries, or damages resulting from the use of AI coaching features.

3.5. telemetry data accuracy: Telemetry data downloaded from devices may contain errors, inaccuracies, or corruption. GPS coordinates, speed readings, lap times, and other metrics may not reflect actual values. Do not rely on telemetry data for safety-critical decisions. We make no guarantees regarding the accuracy or reliability of parsed telemetry data.

3.6. configuration data: Kart configurations and settings that work for one kart, driver, or condition may not be appropriate for another. You are solely responsible for verifying that any configuration data is safe and suitable for your specific kart, engine, track conditions, weather, and skill level before use.

3.7. weather and track conditions: Racing conditions change constantly due to weather, track temperature, rubber buildup, and other factors. Telemetry data, AI coaching advice, and configurations recorded in one condition may be inappropriate or dangerous in different conditions (e.g., wet vs. dry, hot vs. cold). You must independently assess current conditions before each session and adjust your approach accordingly.

4.1. maximum liability exclusion: In no event shall KartPartsPro.com, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, personal injury, property damage, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; (iv) any karting accidents or incidents; and (v) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

4.2. maximum liability cap: Our total aggregate liability to you for all damages, losses, and causes of action shall not exceed the amount you have paid us in the twelve (12) months prior to the event giving rise to the liability, or one hundred dollars ($100), whichever is greater.

4.3. sole proprietor protection: You acknowledge that this Service is operated by a sole proprietor. Under no circumstances shall the operator's personal assets be subject to claims arising from your use of the Service.

4.4. no liability for data loss: We are not responsible for any loss of data, configurations, or content. You are solely responsible for backing up your data.

You agree to defend, indemnify, and hold harmless the Service operator (including as a sole proprietor), and any licensors, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in any way connected with: (i) your access to or use of the Service; (ii) your violation of these Terms; (iii) your violation of any rights of another party; (iv) any decisions or actions you take based on information from the Service; (v) any injury, damage, or loss resulting from your use of configurations or information obtained from the Service; (vi) any content you submit or transmit through the Service; and (vii) any karting accidents or incidents related to your use of the Service.

5.2. This indemnification obligation will survive termination of your use of the Service and these Terms.

6.1. free features: The Service offers free features including telemetry download and local session storage. New users receive free AI coaching credits to try the service.

6.2. credit purchases: AI coaching analysis requires credits, which can be purchased through our pricing page. Credits are non-expiring and remain in your account until used. Each AI coaching analysis consumes one credit.

6.3. refunds: Credit purchases are non-refundable once completed. We recommend purchasing smaller credit packages first to evaluate the service before making larger purchases.

6.4. price changes: We reserve the right to modify credit pricing at any time. Previously purchased credits retain their value regardless of price changes.

6.5. service availability: We reserve the right to discontinue, modify, suspend, or terminate the Service or any features at any time, with or without notice. In the event of permanent service discontinuation, we will work with users to provide reasonable resolution for unused credits.

6.6. no guarantees: While we strive to provide reliable service, we make no guarantees regarding availability, functionality, or data preservation.

6.7. payment processing: All payments are processed securely through third-party payment processors (Stripe). We do not store your payment card information.

6.8. fair use policy: We reserve the right to suspend or terminate accounts that exhibit usage patterns inconsistent with normal personal use, including but not limited to: (i) automated or bulk operations; (ii) reselling or redistributing service access or credits; (iii) any usage that degrades service performance for other users; or (iv) attempting to circumvent credit requirements.

7.1. The Service and its original content, features, and functionality are and will remain the exclusive property of KartPartsPro.com and its licensors.

7.2. You may not modify, reproduce, distribute, create derivative works of, publicly display, or in any way exploit any of the content, in whole or in part, without prior written consent.

8.1. termination by you: You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon termination, your access to the Service will cease, and your data may be deleted in accordance with our data retention policies.

8.2. termination by us: We reserve the right to suspend or terminate your account and access to the Service, with or without notice, for any reason, including but not limited to: (i) violation of these Terms; (ii) violation of the fair use policy; (iii) fraudulent, abusive, or illegal activity; (iv) prolonged inactivity; or (v) at our sole discretion. We may also terminate or suspend all accounts and access to the Service if we discontinue the Service.

8.3. effect of termination: Upon termination, your right to use the Service will immediately cease. We are not obligated to retain your data after termination, and you are responsible for exporting any data you wish to keep before terminating your account. Termination does not relieve you of any obligations incurred prior to termination.

9.1. These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

9.2. mandatory arbitration: Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration. You waive your right to a jury trial and to participate in class actions.

9.3. limitation on time to file claims: Any claim must be filed within one (1) year after the claim arose, or it is permanently barred.

10.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

11.1. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
